Terms and Conditions – Cashback

1. This offer entitles the end user cashback on their Online Wallet or Bank Account Or UPI. The customer will be responsible for their choice of the cashback transfer method. The denomination of the cashback will be mentioned on the voucher/scratch card.
2. Any consumer purchasing promotional product shall be eligible to receive a Voucher inside the pack. The customer shall receive a cashback of an amount equivalent to the value as mentioned in the Voucher (“Cashback/Voucher Amount”).
3. By redeeming the Offer provided on the same, a participant agrees to be bound by the terms and conditions below (“Conditions”).
4. These Conditions apply to every person ("Participant”) redeeming the offer given by Premier Sales Promotions Pvt Ltd, No claim shall lie for any redemption requests made after the expiry of the Offer Period.
5. If you are not a wallet partner registered customer, you will be required to register on the wallet partner website or Mobile App to receive your wallet cashback.
6. The customer will be responsible for entering details such as UPI ID, Account No, Online Wallet Mob Nos, etc. Premier Sales Promotions Pvt Ltd. will not be responsible for any incorrect entries or details on the promotion website. No change in details will be entertained once you have submitted the booking.
7. All Participants agree that wallet partner offering discount vouchers may at any time stipulate additional terms and conditions for redemption of the discount vouchers and such terms and conditions shall be binding on the Participants and shall apply to every redemption of recharge/discount voucher by the Participants.
8. The Wallet Partner holds the right to refuse transactions deemed fraudulent as per their policies. In the event of any fraud detection, the wallet partner reserves the right to modify/change, discontinue, terminate, withdraw the Offer at any time during the Offer Period.
9. The Participant acknowledges that relevant state and central taxes may be deducted by the merchant while redeeming the discount offer and therefore, the amount reflected in the voucher may not be the same as the final redemption value received by the Participant.
10. In no event shall Premiere Sales Promotions Pvt Ltd or its partner agency be held liable for any issues relating to the redemption of the voucher including redemption request not being honoured by the wallet partner.
11. In no event shall the maximum liability exceed the value of the voucher.
12. Any disputes or differences in connection with the offer shall be governed by laws of India and shall be subject to the exclusive jurisdiction of the Courts at Bengaluru.
13. The wallet partner reserves the right to restrict cashback for any account with suspicious behaviour or invalid details/credentials. The wallet partner has the right to ask for documents to prove the customer/user identity.

General Terms & Conditions

1. This offer is not available to employees, Agents, Dealers, or Distributors of CavinKare and PREMIER SALES PROMOTIONS PVT LTD, its clients or agencies and their immediate families.
2. This offer is subject to promotional availability. This offer is not exchangeable for “cash”.
3. This offer is not for sale.
4. Photocopied, torn or mutilated Vouchers will not be accepted.
5. This voucher has no monetary value, is non-transferable and cannot be used in conjunction with any other promotional offers.
6. The usage of this voucher is incumbent upon the terms & conditions to be followed by the voucher holder/purchaser. Such conditions need to be followed by the voucher holder/purchaser.
7. A maximum of one voucher may be used per person, per mobile number per email id per day.
8. Only one voucher per booking will be entertained. Multiple Vouchers cannot be booked together.
9. If you are registered with Do Not Disturb (DND) service, you will not receive an SMS confirmation from us. Please mail us at feedback@bigcity.in for any queries. If Premier Sales Promotions Pvt. Ltd has already emailed or sent by SMS, Premier Sales Promotions Pvt. Ltd will not re-send the voucher code to any new or corrected email address or phone number nominated by the entrant.
10. The “How to Redeem” instructions form a part of these Terms & Conditions.
11. Any costs associated with entering the promotion, including accessing the promotional website, are the responsibility of each entrant. Also, regular call and message rates will apply as per the consumer telecom operator in their respective circles.
12. Cavinare or Premier Sales Promotions Pvt. Ltd. is not responsible in case the Voucher codes have expired for any reason whatsoever.
13. CavinKare or Premier Sales Promotions Pvt. Ltd and the Stores are not responsible for any loss or theft of the Vouchers.
14. No duplicate Voucher shall be issued to the customers.
15. CavinKare Or Premier Sales Promotions Pvt. Ltd. is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
17. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.
18. Caution: Any attempt to deliberately damage the Promoter's promotional website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages, and costs.
19. CavinKare Or Premier Sales Promotions Pvt. Ltd. accepts no responsibility, financial or otherwise for the misuse of Premier Sales Promotions Pvt. Ltd. Vouchers and are not liable for any personal loss or injury and cannot be held responsible for any disagreement concerning the quality/ availability of featured offers. Premier Sales Promotions Pvt. Ltd., its clients, agents, and distributors cannot replace any lost, stolen or damaged Vouchers and reserve the right to withdraw or amend any details and/or prices without notice.
20. Premier Sales Promotions Pvt. Ltd. is acting as an executing agency for this promotional offer and holds no legal and financial liability on unclaimed offers, incentives, Vouchers, etc beyond the applicable period of the promotional offer.
21. CavinKare does not endorse the quality of any of the products or services being offered as Vouchers under the Offer. Any complaints or queries pertaining to the same would have to be taken up directly with the Premier Sales Promotions Pvt Ltd. of such a product or service.
22. The Terms and Conditions of the offer can be changed during the promotional period by PREMIER SALES PROMOTIONS PVT LTD only with prior approval from the Promoter i.e. CavinKare Limited
23. These Terms & Conditions are subject to Indian Law and the exclusive jurisdiction of the Courts in Bangalore.

Contest Details, Concept and Participation:

I. These terms and conditions apply to the "Contest Name" programme for consumers (hereinafter referred to as Contest") sponsored and launched by CavinKare Pvt Ltd wherein consumers can participate by sending an SMS with Unique Code printed on the pack in the following format: KEYWORD  Unique CODE to 9902391200

 

II. The contest is valid only in India from 01/10/2020 to 15/01/2021 (herein after referred as "Contest Period").

 

III. During the Contest Period: 

• The Contest is subject to all applicable central, state and local laws and regulations.

• Consumers participating or seeking to participate in the Contest shall individually be referred to as "Participant" and collectively as "Participants".

2.      Agreement to Terms and Conditions:

• By participating in this contest, Participants fully and unconditionally agree to and accept these Terms and Conditions available on www.meera.bigcityexperience.com ("Contest Website"). The decisions of CavinKare Pvt Ltd will be final and binding in all matters related to the Contest. Successfully entering the Contest and winning a prize is subject to all requirements set forth herein.

• CavinKare Pvt Ltd reserves the right to exclude any person from the contest on grounds of misconduct or criminal record or for any other reasons, as it may deem fit and proper. No communication in the regards will be entertained.

• CavinKare Pvt Ltd. reserves the right to terminate, modify or extend the Contest and/or deletion or addition of any of the terms and conditions of the Promo, at any time at its absolute discretion, without advance notice and / or assigning any reason thereof. All decisions of CavinKare Pvt Ltd in respect of the Contest and the prizes therein will be final, binding and conclusive.

3. Eligibility:

• This Contest will be open to all the residents of India

This contest is not applicable to employees, their immediate family members, agents, distributors, retailers and any other channel partner of CavinKare Pvt Ltd and the agency.

• This contest is open for adults above 18 years.

• CavinKare Pvt Ltd or its Agency will not be responsible for any NDNC (National Do Not Call) Registry regulation that will come into play. All Participants who participate will agree as per the terms and conditions that even if they are registered under NDNC, DND (Do Not Disturb), CavinKare Pvt Ltd or its Agency will have all the authority to call such shortlisted winners by virtue of them having voluntarily participated in the Contest.

 

4. Contest Period & Contest Timings:

• The contest will commence from 12.00:01 AM on 01/10/2020 to 11:59:59 PM on 15/01/2021

• Time of participation will be defined as the time at which the entry is received through the SMS/Online mode of participation at CavinKare Pvt Ltd computer.

•Entries coming outside the Contest Period will not be considered for winner selection.

• The contest shall run on the following SKUs of Meera Powder Pouch  Rs. 4 Sachet, 40g Pouch, 80g Pouch, Container

5.      Prizes:

• Prize – During the Contest Period, winners will be selected for Gold Coins and cashback Prize every day for the contest period. Therefore there will be total of 60 Gold Winner & 36,600 Cash Back Winner. Such prizes which will be declared during the contest period.

6. How to Participate:

Any participant can enter the contest any  number of times during the contest period from a mobile number using a valid unique code. One unique code can be used only once

CavinKare Pvt Ltd and the Partner Agency shall not be responsible for (including but not limited to):

- For any SPAM generated messages

- For the Operator Code not being displayed on the user's mobile phones

- For any SMS message delivery failures

- Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason

- If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ - Participant has specifically requested for not receiving messages for the specific campaign

- Other conditions beyond its reasonable control

7. Winner Selection:

Any participant can win a max of 1 reward during the contest period from a mobile number

• From the Valid Entries received, the Organizer will select 60 Gold Coin Winners, 3600 Rs. 100 Cashback Winners and 33,000 Rs. 50 Cashback Winners during the contest period. (Total 36,660 winners in the entire promotion) who will win Gold Coins and cashback throughout the Promotion Period (“Winners”).

• Winners will be selected by the Organizers via shortlisting the Valid slogans, entered by them. Top slogans will be selected for Gold Coin prize, remaining shortlisted ones will be allocated for  the cashback reward.
 

• Prizes will be given subject to the winner satisfying the verification process of CavinKare Pvt Ltd

 

• The Prize cannot be transferred, exchanged or redeemed for cash. In the event that the winner does not take the prize in the time and manner stipulated, then the prize will be forfeited from the winner and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied. Any unclaimed prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken in exchange for cash.

• Any unused prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken in exchange for cash.

• CavinKare Pvt Ltd. shall provide the prize on an "as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort, and CavinKare Pvt Ltd. and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any product/service and/or the prize or for any kind of consequential damages/ loss, in any manner whatsoever. If any Participant has any grievance with respect to the prize, he/she may directly contact the manufacturer.

• The image of the prize depicted on the press ads/posters/TVC's/pack shots etc. are for illustrative purposes only and the actual prize may vary from the depiction made.

• CavinKare Pvt Ltd.. or its Agencies shall not be liable for any loss or damage of the prize due to Act of God, Governmental action, Force Majeure circumstances and / or any other reasons which are beyond the reasonable control of CavinKare / its Agency, and under no circumstances, CavinKare shall be liable to pay any compensation whatsoever for such losses.

• Any participant of the contest who wins any one of the prize during the Contest Period shall not be eligible to win any further prizes.

• The winner generation for Daily Prizes will be done on the basis of Valid Unique Code + Unique mobile number.

8. Contacting Winners:

                
8.a. Cashback WINNERS:
The winner for cashback vouchers will be sent their reward code along with the weblink, on their winning mobile number. The winners will visit the weblink and can claim their cashback.

8 b. Gold Coin Winners:

     i.        Once the Winners are selected, the Partner Agency appointed by CavinKare Pvt Ltd. shall process the gift for the winner.

   ii.        In the event the shortlisted winner's number is busy, unreachable, or he/she does not attend the call, two (2) more attempts will be made to reach the Participant on that day and/or the next day.
 

  iii.        If even on the third attempt, the Participant does not attend the call, or is unreachable, the Participant's participation in the contest comes to an end and the Participant's entry stands cancelled and Participant becomes ineligible to receive the prize.

  iv.        In the event the shortlisted winner attends the call on either the second or third attempt, the procedure outlined in step (v) shall apply.

    v.        If any shortlisted winner remains unreachable on the third attempt or is not interested in continuing in the Contest or is otherwise ineligible to participate, the Agency shall conduct up to two (2) more random selections to shortlist a Participant. If even after a third random selection, no winner is selected, no prize shall be declared in respect of the contest.

In case of a positive response from the shortlisted winner, each such shortlisted winner will be required to send the following documents and collateral:

 

1. Copy of Address proof (Electricity bill or Mobile Bill)

3. Copy of PAN card is mandatory

4. Copy of Aadhar Card is mandatory

 

This will be referred to as Participation Package for the winner. The completed Participation Package needs to be sent by email (win@bigcity.in) or by registered post with Acknowledgement Due to the address mentioned below or by courier so as to reach within 7 days of the call made by Agency to the selected winner:

Upon receipt of the Participation Package, CavinKare Pvt Ltd.. or its Agency shall scrutinize all documents. If all the documents and the wrapper submitted are in order and valid then be treated as a Confirmed Winner.

 

No prize will be awarded if the information presented by the Participant(s) at the time of entering the contest is not factually correct.

The cost and expenses of postage shall be borne by the participant himself. CavinKare Pvt Ltd. or the Partner Agency shall not be responsible for any accident or mishap or loss of the Participation Package by the participant in transit.

 

The responsibility of ensuring that the Participation Package reaches the address as directed by CavinKare Pvt Ltd. or its Partner Agency lies solely with the participants.

 

No justification/explanation for non-receipt of the Participation Package or any missing documents shall be accepted.

In the event of death of the Confirmed Winner, no claim from the nominee or his/her legal heirs of the Confirmed Winner shall be entertained for receiving the prize.

9.Publicity:

• The Participant/s undertake and irrevocably and unconditionally permit CavinKare Pvt Ltd. to cover the Contest through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.

• The winners must, at the request of CavinKare Pvt Ltd., participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to CavinKare Pvt Ltd.. using their name and image in promotional material.

10.    Intellectual Property:

a.    All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with CavinKare Pvt Ltd.. at all times. CavinKare Pvt Ltd.. or any person or entity permitted by CavinKare Pvt Ltd.. in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.

b.   All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to CavinKare Pvt Ltd.. upon submission and become the property of CavinKare Pvt Ltd.. exclusively.
